Participation of European Research Entities
in Industrial R&D Projects Supported by the Office of Chief Scientist< /H3>
Israel and the European Community have
signed an Agreement on Scientific and Technical
Cooperation Between the European Community and the State of Israel
("The Agreement"). The Agreement was published as a Council Decision in
O.J. No. 209 of 19.8.96 p. 22-31.
Under Article
1 of the Agreement it was agreed:
Research entities established in Israel
may participate in all the specific programs of the Fourth Framework Program.
Research entities established in the
Community may participate in research programs and projects in Israel in
themes equivalent to those of the programs of the Fourth Framework Program.
The Office
of the Chief Scientist of the Ministry of Industry and Trade has various
programs for the encouragement of industrial R&D. A summary of those
programs is given in the OCS publication: Government Encouragement for
Industrial Research and Development in Israel (latest edition 97).
There are two types of encouragement
programs:
Grant options under the Law for the
Encouragement of Industrial R & D ("The Law").
Grant options according to Directives
of the Director General of the Ministry of Industry & Trade (the "D.G.
Directives").
The Industrial Research and Development
Programs and all the international cooperation activities of the OCS are
performed or created and operated under the provisions of the Law.
The other programs performed under
the D.G. Directives are usually programs for the creation of technological
infrastructure, products demonstration, and training & support for
individual entrepreneurs.
According to the Agreement, the programs
aimed for the encouragement of Industrial R&D are open to participation
of research entities from EU countries in cooperation with Israeli Industries.
The agreement refers in Article
2 to the participation of the EU research entities as follows:
"Cooperation may take the following
form: ...
- participation of research entities
(established in Community) in Israeli research projects and their results,
in accordance with the terms and conditions applying in Israel in every
case; research entities established in the Community participating in Israeli
research projects within research and development programs shall cover
their own costs, including their relative share of the project’s general
management and administrative costs".
And in Article
9: ...
"6. ‘For research entities from the
Community, the terms and conditions applicable for the submission and evaluation
of proposals and those for the granting and conclusion of contracts for
projects within Israeli and development programs shall be equivalent to
those applicable for contracts concluded under the same research and development
programs with research entities in Israel, subject to Annex C, taking into
account the mutual interests of the Community and Israel."
Annex C
gives additional ground rules for the participation of the EU research
entities in Israeli programs. Relevant reference to programs of the OCS
are in the following paragraphs of the Annex:
The participation of research entities
established in the Community in projects of Israeli research and development
programs shall require the joint participation of at least one Israeli
research entity. Proposals for such participation shall be submitted jointly
with the Israeli research entity/ies./LI>
The rights and obligations of research
entities established in the Community participating in Israeli research
projects within research and development programs, and the terms and conditions
applicable for the submission and evaluation of proposals and for the granting
and conclusion of contracts in such projects, shall be subject to Israeli
laws, regulations, and government directives governing the operation applicable
to Israeli participants and assuring equitable treatment, taking into account
the nature of the cooperation between Israel and the Community in this
field.
Depending on the nature of the project,
proposals may be submitted to:
the Office of the Chief Scientist in
the Ministry of Industry and Trade. Except for projects in the field specified
in (ii) below, there are no predefined fields for projects in this research
and development program. Projects may be submitted in any field of industrial
research and development./LI>
the Office of the Chief Scientist in
the Ministry of Industry and Trade for proposals in the fields of pre-industrial
projects within the framework of academic institutions./LI>
Cooperation in Industrial R&D between
Israeli industries and research entities for the EU countries will be reviewed
and approved using the same procedures as cooperation projects performed
with research entities from countries with whom Israel and the Office of
the Chief Scientist have bi-lateral (parallel support - hot funds) agreements.
